1. Scope and responsible company
Everest Digital LLC, is the controller of personal information described in this Policy unless a supplemental notice states otherwise. The developer or seller identified in an applicable app-store listing is the service operator for that distribution channel.
Features may differ across the web, iOS, macOS, and Android versions and may change during testing. This Policy describes categories of features Fluent Face may offer; it does not mean every feature is available on every platform.
2. Personal information we collect
2.1 Account and identity information
When you create or manage an account, we may collect your name, email address, account identifier, authentication provider, authentication status, and account creation or update timestamps. Authentication is provided through Amazon Cognito and may use Google or another supported identity provider. We do not receive your Google password, and passwords are not intended to be stored in readable form in Fluent Face application databases.
2.2 Voice, speech, text, and AI interactions
When you activate a conversation, we may process microphone audio, speech transcripts, typed text, selected language, selected digital human, voice and transcription model settings, conversation context, AI responses, quality or safety signals, and session metadata. Audio may be streamed in real time. Depending on the selected or experimental feature, speech may be transcribed or generated by OpenAI, Experts Alive, an operating-system or browser speech service, or another provider identified in an updated notice.
Fluent Face does not use voice input to identify you by a biometric voiceprint or to clone your voice. We do not currently use raw microphone recordings to train a general-purpose AI model. Do not include confidential information or another person’s personal information unless you have the right to provide it.
2.3 Device, network, usage, and diagnostic information
Our systems and providers may automatically receive your IP address, browser or app version, operating system, device type, language and time-zone settings, requested URLs, access times, authentication events, feature interactions, usage credits or minutes, crash data, API requests, and security logs. Local or session storage may remember your sign-in state, selected digital human, language, preferences, and downloaded digital-human assets.
Developer audio diagnostics are restricted to an authorized administrator. Current diagnostic reports are designed to exclude raw audio, transcripts, credentials, and email addresses and may include bounded technical timing, browser, model, and playback-state information needed to investigate failures.
2.4 Feedback, support, and friend invitations
We collect information you provide in feedback, support requests, bug reports, surveys, or other communications, together with our response and related account or diagnostic context.
If you use Share with Friends, we process the email addresses you enter, your account name or email, delivery status, message identifier, recipient email domain, bounce or complaint information, and invitation-count limits. Invitations are sent individually through Amazon Simple Email Service. Do not submit an address unless you reasonably believe the recipient would welcome the one-time invitation.
2.5 Information not requested by the core demo
Fluent Face does not currently charge for the demo and does not request payment-card details. The core demo does not intentionally collect precise geolocation, address-book contacts, photos, health information, or government identification. A future feature that needs a new category of information will provide additional notice as required.
3. Sources of information
- Directly from you when you create an account, select settings or a digital human, speak or type into a feature, invite a friend, or contact us.
- From authentication providers, app stores, operating systems, and services you connect to Fluent Face.
- From service providers that host, secure, transmit, transcribe, generate, troubleshoot, or deliver the Services.
4. How we use personal information
- Create, authenticate, maintain, and secure accounts and sessions.
- Provide realtime voice conversations, speech recognition and generation, selected digital humans, language handling, and synchronized facial motion.
- Remember selections, manage monthly demo usage, and synchronize supported settings across platforms.
- Send account or security messages, requested one-time friend invitations, and responses to support requests.
- Investigate bugs, audio failures, outages, misuse, fraud, and security incidents and enforce the Terms of Service.
- Measure reliability and feature use, improve the demo, and create aggregated or de-identified statistics.
- Comply with law, respond to valid legal process, protect rights and safety, and establish or defend legal claims.
Where a law requires a legal basis, we rely as appropriate on performance of our agreement with you, legitimate interests in operating and securing the Services, consent for microphone access or another activity where required, and compliance with legal obligations. You may withdraw consent prospectively, but a feature that requires the relevant information may stop working.
5. How we disclose personal information
- Amazon Web Services, including Cognito, APIs, hosting, content delivery, storage, databases, email delivery, monitoring, and security services.
- OpenAI for realtime or generative AI interactions, speech transcription, speech generation, translation, safety, and related functions you request.
- Experts Alive for digital-human catalog, assets, session authorization, facial-motion and lip-sync runtime, and related conversational infrastructure.
- Google, Apple, app stores, browsers, operating systems, and identity providers for sign-in, distribution, permissions, and their independent platform services.
- Support, security, diagnostics, communications, and professional-service providers acting for authorized purposes.
- Courts, regulators, law enforcement, advisers, or other parties when reasonably necessary to comply with law, investigate abuse, protect rights or safety, or resolve claims.
- A buyer, lender, investor, adviser, or successor in a financing, merger, acquisition, reorganization, or sale, subject to appropriate confidentiality and notice requirements.
We do not currently sell personal information or share it for cross-context behavioral advertising. Providers may independently control data for their own platform, storefront, security, or legal obligations; their notices apply to those activities.
6. Microphone, voice, AI, and digital-human processing
Microphone access begins only after you activate a conversation feature and grant device or browser permission. You may revoke access in system or browser settings. Fluent Face should stop microphone capture when the application is muted or placed in the background and establish a fresh session when it returns to the foreground. A conversation cannot work without microphone input.
AI systems can mishear speech, generate inaccurate or inappropriate content, or behave differently across languages, accents, devices, and network conditions. Digital humans are fictional or licensed representations and are not the real people they may resemble. We do not use automated systems to make legal or similarly significant decisions about you.
7. Cookies and local storage
The web Service uses cookies, local storage, session storage, and similar technologies needed for authentication, security, preferences, selected content, and core operation. Blocking them may prevent sign-in or other features from working. If we introduce non-essential analytics, advertising, or marketing technologies, we will update this Policy and provide required controls.
Because Fluent Face does not currently sell personal information or share it for cross-context behavioral advertising, there is presently no such processing to opt out of. Where legally required and technically supported, we will honor recognized opt-out preference signals for activities to which they apply.
8. Retention and deletion
We retain personal information only as long as reasonably necessary for the purposes described here. Account and preference information is generally retained while the account remains active. Voice audio may be processed transiently; transcripts, session metadata, usage records, safety signals, and technical logs may be retained for a limited period when needed to operate, secure, troubleshoot, or improve the Service. SES monitoring logs may retain limited delivery information for operational monitoring. Protected backups may take additional time to age out.
You may request account and associated data deletion through an available account setting or by emailing support.fluentface@everestdigital.ai. We may verify your identity. We will delete or de-identify data within a reasonable period and instruct processors as required, while retaining limited records when required for law, security, abuse prevention, dispute resolution, or documentation of the request.
9. Security
We use administrative, technical, and organizational safeguards designed to protect personal information, including authenticated access, encryption in transit, access controls, managed cloud services, monitoring, rate limits, and secret-management practices. No system is completely secure. Protect your device and account and contact us if you suspect misuse.
10. International data transfers
Fluent Face is operated from the United States and uses providers that may process information in the United States and other countries. Those countries may have different privacy laws. Where required, we use or require a recognized transfer mechanism and supplementary protections appropriate to the processing.
11. Your privacy rights
Depending on where you live and subject to legal exceptions, you may have rights to:
- Know how we collect, use, disclose, and retain personal information.
- Access or obtain a copy of personal information associated with you.
- Correct inaccurate personal information.
- Delete personal information.
- Receive certain information in a portable format.
- Object to or restrict certain processing and withdraw consent for future processing based on consent.
- Opt out of qualifying sale, sharing, targeted advertising, or profiling if those activities occur.
- Appeal a privacy-request decision, complain to a regulator, and receive equal service for exercising a right.
Email support.fluentface@everestdigital.ai with the subject "Privacy Request," describe the request, and include the email associated with your account. We may request information reasonably necessary to verify identity and authority. An authorized agent may submit a request where permitted, subject to proof of authority. To appeal, reply with the subject "Privacy Appeal."
12. U.S. state privacy notice
For residents of U.S. states with comprehensive privacy laws, the categories described above may include identifiers and account data; internet, device, and usage activity; audio and electronic information; interaction and support content; and inferences used to operate or personalize the demo. We disclose these categories for business purposes to the providers and recipients described in Section 5. We do not currently sell them or share them for cross-context behavioral advertising.
Where treated as sensitive under applicable law, account credentials and voice or conversation data are used only as reasonably necessary to provide, secure, troubleshoot, or improve the requested feature, or with consent where required.
13. Children and teens
The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 to create an account. If local law requires a higher age for consent, a parent or legal guardian must validly participate and consent. We do not knowingly collect personal information from a child under 13 without legally valid parental consent. Contact us if you believe this occurred so we can investigate and take required action.
14. Third-party links and services
The Services may link to Fluent Face, Avalingo, Experts Alive, app stores, authentication providers, or other third-party sites and services. Their privacy notices govern their independent processing. A link does not mean we control or endorse every third-party practice.
15. Changes to this Policy
We may update this Policy for changes in features, providers, law, or our practices. We will post the revised Policy and effective date and provide additional notice when required. If consent is required for a materially different use, we will request it.
